1. About Vinho Sem Medo

Vinho Sem Medo is a wine marketplace operated by Izhar Perlman, a sole trader registered in Portugal with NIF 216 828 023, with registered address at Largo da Cutelaria 8, 2550-354 Cadaval, Portugal.

The platform operates at vinhosemmedo.pt and connects independent Portuguese wineries directly with buyers, without acting as a retailer, reseller or intermediary in the commercial transaction between them.

2. Scope of these Terms

These Terms apply to all users of vinhosemmedo.pt, including:

• Wineries — producers who register and list wines on the marketplace
• Buyers — individuals who purchase wines through the marketplace
• Amigos do Vinho — approved reviewers who participate in the review programme

By using the platform, you agree to these Terms. If you do not agree, do not use the platform.

3. Winery Membership

3.1 Registration

Wineries must register and pay a membership fee to list wines on the marketplace. Registration requires a valid Stripe account for payment processing.

3.3 Suspension and expiry

Upon expiry without renewal, the winery page and all listed wines are suspended (hidden from buyers) but not deleted. Data is retained for 12 months after expiry. VSM reserves the right to suspend a winery account at any time for violation of these Terms, with no refund of membership fees.

3.4 Commission

VSM charges zero commission on sales. The winery keeps 100% of each sale. Payment goes directly from buyer to winery via Stripe.

4. Payments

All payments on vinhosemmedo.pt are processed by Stripe. VSM does not store, process or have access to card data. By completing a purchase, you also agree to Stripe's terms of service.

5. Buyer Purchases

5.1 Minimum order

The standard minimum order is 6 bottles of the same wine reference per case. Some wineries may offer different quantities — see the individual winery page. VSM does not guarantee uniform minimum quantities across all wineries.

5.2 Mixed cases

Mixed cases (different wine references from the same winery in one order) are permitted only where the winery explicitly allows it. Mixed cases are not covered by the VSM Guarantee.

5.3 Age requirement

You must be 18 years of age or older to purchase alcohol. By placing an order you confirm you meet this requirement.

5.4 Contract of sale

The contract of sale is between the buyer and the winery. VSM acts as the marketplace platform and is not a party to the sale. Order confirmation is sent by email upon successful payment.

6. VSM Guarantee

6.1 What is covered

The VSM Guarantee applies to cases of 6 bottles of the same wine reference, purchased through vinhosemmedo.pt. It allows the buyer to open one bottle and, if not satisfied, return the remaining 5 for a full refund.

6.2 Conditions

• Only 1 bottle may be opened
• The remaining 5 bottles must be unopened and in original condition
• The claim must be submitted via the VSM Guarantee form at vinhosemmedo.pt/loja/garantia.php
• Return shipping is at the buyer's cost
• The refund covers the 5 returned bottles only, not the opened bottle or shipping

6.3 What is not covered

• Mixed cases (different wine references)
• Orders where more than 1 bottle has been opened
• Damage caused during return shipping
• Claims submitted more than 14 days after confirmed delivery

6.4 Process

VSM mediates the return between the buyer and the winery. The winery is responsible for issuing the refund for returned bottles. VSM coordinates but does not guarantee the financial solvency of individual wineries.

7. Shipping

Shipping is handled directly by each winery. Rates, carriers and delivery times vary by winery and destination. VSM is not responsible for delays, damage or losses during shipping. For shipping issues, contact VSM via the Guarantee form or by email.

8. Obligations

Wineries agree to:

• Provide accurate product information, prices and stock levels
• Dispatch orders within a reasonable time (recommended: 3 business days)
• Honour the VSM Guarantee for eligible orders
• Not contact buyers directly regarding Guarantee disputes without VSM coordination
• Maintain a valid Stripe account throughout the membership period

Buyers agree to:

• Be of legal drinking age (18+)
• Provide accurate delivery information
• Use the Guarantee form for complaints rather than chargebacks where possible
• Return bottles in original condition when claiming the Guarantee

9. Limitation of Liability

VSM operates as a marketplace platform. To the maximum extent permitted by law, VSM is not liable for:

• The quality, legality or fitness of wines listed by wineries
• Delays, losses or damage caused during shipping
• Winery failure to dispatch or refund
• Indirect or consequential losses arising from use of the platform

VSM's maximum liability to any party is limited to the membership fee paid in the 12 months preceding the claim.

10. Intellectual Property

All content on vinhosemmedo.pt — including design, text, code and the VSM brand — is owned by Izhar Perlman / Vinho Sem Medo. Wineries retain ownership of their own content (descriptions, photos, wine information) but grant VSM a non-exclusive licence to display it on the platform during the membership period.

11. Termination

VSM may suspend or terminate any account at its discretion for breach of these Terms. Membership fees are non-refundable upon termination for cause. Wineries may close their account at any time by contacting VSM — their page will be suspended upon membership expiry.

12. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the Portuguese courts. For consumer disputes, buyers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
